What are enforcement undertakings?

An enforcement undertaking is a voluntary offer made by an offender to put things right after an environmental offence has occurred.

This may include correcting the non-compliance, restoring environmental harm, improving future compliance and making a financial contribution to an environmental project or affected community.

Why we use them: To secure meaningful environmental improvements and encourage organisations to address the consequences of their offending.

    What are civil sanctions?

Civil sanctions are formal enforcement tools that can be used instead of prosecution in appropriate circumstances.

They allow us to take proportionate action where environmental laws have been broken and can provide significantly quicker outcomes than criminal proceedings.

Why we use them: To hold offenders accountable and secure improvements without the time and cost of court action where this is the most appropriate response.
